Please read these Terms and Conditions (“Terms”) carefully before using the www.hibiscustherapy.com website (the “Site”) and any services offered through it. These Terms apply to all visitors, users and others who access the Site and book services.

1. Introduction

1.1 These Terms govern your use of the Site and any booking or purchase of services offered by Hibiscus Therapy (“we”, “us”, “our”).

1.2 By accessing the Site and/or making a booking or purchase, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you must not use the Site.

1.3 The Site is operated from the United Kingdom. Services offered are available in-person (where stated) and online as described on the Site.

2. Eligibility

2.1 By using the Site, you confirm that you are at least 18 years old.

2.2 By booking a service, you warrant that all information you provide is true, accurate, and not misleading.

3. Services

3.1 Hibiscus Therapy offers personalised clinical hypnotherapy and related services, including but not limited to:

  • Clinical hypnotherapy sessions for anxiety, stress, phobias, pain management, confidence building, sleep support, habit change, and emotional balance;
  • Hypnobirthing sessions, courses, and support for expectant parents;
  • Online and in-person consultations;
  • Digital resources and follow-up support where stated.

3.2 Services vary in duration, format, delivery method and price as described on the Site and in relevant booking pages. Prices and service descriptions may be updated from time to time.

4. Booking & Payment

4.1 You may book services through the Site or via provided booking links.

4.2 Payment is required at the time of booking unless otherwise stated. Prices are in GBP (£) and include VAT where applicable.

4.3 All payments are final, unless otherwise stated in these Terms or required by applicable law.

4.4 We reserve the right to refuse, cancel or change bookings where necessary, including in cases of suspected fraud, error, or where a service is unavailable.

5. Cancellations, Rescheduling & Refunds

5.1 General Hypnotherapy Sessions (Non-Hypnobirthing)

  • A minimum of 48 hours’ notice is required to cancel or reschedule an appointment.
  • Appointments cancelled with less than 48 hours’ notice may be charged in full.
  • In certain circumstances, appointments may be rearranged at our discretion.
  • Where sessions are delivered at a hired venue or involve travel, a venue and/or administration charge may apply. Any such charges will be agreed in advance where possible.

5.2 Hypnobirthing – Private Classes

Sickness

If you or your birth partner are unwell and unable to attend a private class:

  • The session may be rescheduled at no additional cost, at a time mutually convenient and subject to availability.
  • Wherever possible, the session may instead take place online.
  • Refunds will otherwise be issued in accordance with the general refund terms set out in these Terms.

Multiple Reschedules

If more than one session requires rescheduling, additional associated costs (such as venue hire, travel, or administration) may apply.

  • Every effort will be made to avoid such charges.
  • Any additional costs must be agreed in advance and paid prior to the rearranged session.

5.3 Hypnobirthing – Group Classes

If you or your birth partner are unwell and unable to attend a group class:

  • We will endeavour to offer you a place on the next available group course (subject to availability).
  • Course content materials from the missed session will be provided via email.
  • Refunds are not available for missed group sessions unless otherwise required by law.

5.4 Early Birth

If your baby is born before you have completed your hypnobirthing course:

  • You may request a pro-rata refund for any sessions that have not yet taken place.
  • Refunds will be calculated based on the remaining unused sessions.

5.5 Digital Resources

Digital materials, downloads, and emailed course content are non-refundable once provided.

5.6 Statutory Rights

Nothing in this policy affects your statutory rights under UK consumer law.

5.3 Digital Products & Resources

  • Downloadable or delivered digital content is non-refundable once delivered.

5.4 All refunds (where applicable) will be made using the original payment method.

5.5 Any disputes over charges or refunds must be raised within 14 days of the relevant appointment date.

6. Online Services

6.1 Online services are delivered by video such as Zoom or Microsoft Teams. You agree to use a suitable device and an internet connection.

6.2 You accept responsibility for your technology and internet connection. We are not liable for interruptions outside our control.

6.3 We reserve the right to conduct sessions in an uninterrupted, confidential environment. You agree to participate in a quiet and private space.

7. Client Responsibilities

7.1 Clients must provide accurate personal and contact information.

7.2 Hypnotherapy and related services are supportive and not a substitute for medical or mental health care. You acknowledge that services do not guarantee specific outcomes.

7.3 If you have existing medical or psychiatric conditions, you should consult your GP or licensed healthcare professional before participating in any hypnotherapy or related service.

8. Intellectual Property

8.1 All content on the Site, including text, graphics, logos, audio and video, is the property of Hibiscus Therapy or its licensors and is protected by copyright and other intellectual property laws.

8.2 You may use content for personal, non-commercial purposes only. You may not reproduce, distribute, modify, transmit, or otherwise use content without prior written consent.

9. Limitation of Liability

9.1 To the maximum extent permitted by law, Hibiscus Therapy, its officers, agents and affiliates are not liable for any indirect, incidental, special or consequential damages arising from use of the Site, delivery of services, or reliance on any information provided through our services.

9.2 Our total liability to you for any claim arising out of or in connection with these Terms shall not exceed the amount you paid for the services in question.

10. Privacy & Data Protection

10.1 Our collection and handling of personal data is outlined in our Privacy Policy which forms part of these Terms.

10.2 By using the Site and booking services, you consent to our handling of personal data as described.

11. Changes to Terms

11.1 We reserve the right to update these Terms at any time. Where changes are material, we will make reasonable efforts to notify you prior to the changes taking effect.

11.2 Continued use of the Site after changes constitute acceptance of the new Terms.

12. Governing Law & Disputes

12.1 These Terms are governed by the laws of England & Wales.

12.2 Any disputes shall be subject to the exclusive jurisdiction of the English courts.
